When to use it

On receipt of any appeal against redundancy selection or the process followed.

Hearing a redundancy appeal properly

An appeal is not a formality. Handled well, it can correct an error before it becomes a claim and can cure a procedural defect earlier in the process. Handled as a rubber stamp, it adds a second unfair decision to the first.

Who should hear it

Someone independent of the original decision, ideally more senior, with authority to change the outcome. If nobody internally is independent, use an external chair. An appeal heard by the person who scored the employee is worse than no appeal at all.

Scope

Set out at the start whether the appeal is a review of the original decision or a rehearing, and be consistent across the group. The template records the grounds of appeal, the evidence considered, the questions asked, and the reasoning behind the decision — including where a ground is rejected.

The grounds you will see most

Challenges to the pool, to a specific score, to the redeployment search, and to the fairness of the process. Each has a corresponding record you should pull before the hearing: the Selection Pool Definition Worksheet, the Selection Criteria and Scoring Matrix and the Redeployment and Suitable Alternative Vacancy Tracker.

Outcomes

An appeal can uphold the decision, overturn it, or uphold it while correcting something — for example, extending a redeployment search or adjusting a score without changing the outcome. Record which, and why, in writing to the employee within the timescale you promised.

Handling it humanely

People appeal for many reasons, not all of them about the score. Give them a proper hearing, allow them to be accompanied, and be clear about what happens next. The decision chapter of our restructuring guides covers appeals in more depth.
